These General Terms and Conditions apply to all contracts for the purchase of goods and services ("Products") offered under www.elivrosenkranz.at, in particular for printed or unprinted paper goods and calligraphy services.
Conclusion of contract and further process
By completing the order process (clicking on the "Order with an oblgation to pay" button) you ("Customer") make a binding offer to purchase the products in your shopping cart and accept the General Terms and Conditions in the version valid at that time. The automatic order confirmation sent by us after completion of the order process does not represent an acceptance of your offer, but merely that we have received the order. A contract is only concluded upon our express declaration of acceptance.
After acceptance, your paper will be produced and shipped no later than four weeks after reception of payment.
If the products are not made to customer specifications or are not tailored to your personal needs, they will be shipped no later than 3 working days after receipt of payment, if in stock.
We will declare acceptance of the contract for these products by a separate e-mail as soon as the goods leave our warehouse (dispatch confirmation) or at the latest by delivery of the goods. This also applies if you have already paid or approved payment of the purchase price before the conclusion of the contract due to the method of payment selected. If in this case we are exceptionally unable to accept your order due to lack of availability of goods or if the contract is not concluded for other reasons, we will of course immediately refund the advance payment.
Products and product availability
All products, contents, specifications and prices may be changed by us at any time prior to the conclusion of the contract without prior notification or announcement. We may make changes to the designs displayed on this website at any time, in particular if we deem it necessary to design or maintain the integrity of the product in question.
If at the time of the order the goods ordered by you which do not need to be manufactured according to customer specifications or are not tailored to your personal needs are not available at short notice, we usually inform you within 24 hours. If the goods are permanently unavailable, no contract will be concluded and we will inform you of this. For a delivery delay of more than two weeks, you have the right to rescind the contract.
Place of performance, delivery period
Place of performance is the registered office of the seller, 2811 Wiesmath, Austria.
The delivery time depends on the production and shipping time. The production time of your product depends on the selected individualization.
The production time of the handmade paper is usually 3 - 4 weeks from the conclusion of the contract.
Goods that are not manufactured according to customer specifications will be shipped within 3 working days after receipt of order, if in stock.
Changes after conclusion of the contract, resulting costs
Should you wish for any changes after your order has been completed you have the opportunity to email us within 24 hours of completing your order at firstname.lastname@example.org. If the timeline of 24 hours has passed it is not possible to request any changes.
Purchase price and due date, default in payment
All prices on this website are in Euros and do not include VAT. Due to the small business regulation, no sales tax is shown on the invoice.
Packaging and shipping costs, if any, will be charged and shown separately.
Unless expressly agreed otherwise, you as the customer are obliged to pay the purchase price in full upon conclusion of the contract. Payment can be made by credit card, Paypal or bank transfer. The production and/or delivery of the goods takes place only after receipt of the amount in our bank account.
In the event of default in payment, we shall be entitled to charge all costs necessary for appropriate legal proceedings. In the event of default in payment, default interest in the amount of 10% p.a. shall be deemed agreed.
Right of Withdrawal
The handmade paper offered for sale is custom made and/or distinctly tailored to your personal requirements. The customer is therefore not entitled to withdraw from the contract pursuant to Section 18 para. 1 no. 3 FAGG (Distance and Foreign Trade Act).
This not applies to those products that are not made to customer specifications or are not tailored to your personal needs, in particular our greeting cards.
If you do not like one of these delivered items, you can return it within 14 days after receipt. However, we only accept returns in their original condition and packaging. The costs of returning the item/s are at your expense. A credit resulting from the accepted return will be settled immediately.
Information on exercising the right of withdrawal
The statutory warranty provisions shall apply. The warranty period for the delivery of movable goods is 2 years from acceptance. The warranty applies exclusively to defects that existed when the item was handed over.
Please note that due to the uniqueness of our handmade paper, the properties of the individual paper can vary greatly. Differences in size, shape, color, printability and design of the paper are to be expected and do not constitute a defect. These variations can extend to all graphics and designs, no matter what printing method is used on our handmade paper. These are not defects of the product, but variations in the colors, shapes, sizes or finishes of our handmade products resulting from their uniqueness.
We endeavor to reproduce the properties including the colors of our products on the website as accurately as possible. However, the display of the color also depends on your computer system and/or screen. Deviations resulting from this do not constitute a defect.
Retention of title
The product remains our property until full payment has been received.
Ownership of image material, copyrights
All works of art, images and designs, including those used throughout the design process and displayed or described on our website, remain our property and may not be used for personal use, reproduction or any other purpose. Under no circumstances may our works be reproduced, duplicated or used for any purpose whatsoever. Likewise, edited or derivative works may not be produced.
This website and the contents thereof, including (but not limited to) all codes, contents, images, graphics and designs, are our property. No part of this website may be copied, reproduced or used without our written consent. Please address any such requests to: email@example.com
Data protection, data security
We strive for maximum security of your privacy while you shop on our site. We will never give or sell your information and data to third parties. The only information we hold is the information we need to contact you regarding your order and to fulfill the contract.
Our site is secured by SSL encryption to ensure that your personal information remains confidential and does not fall into the wrong hands.
All amendments and supplements to this agreement must be made in writing. This also applies to waiver of the written form requirement.
Place of jurisdiction, applicable law
The exclusive place of jurisdiction for all disputes arising from and in connection with the contracts is the competent court at the Vendor's registered office.
The contractual relationship is exclusively subject to Austrian substantive law to the exclusion of referral standards (IPR) and the UN Convention on Contracts for the International Sale of Goods.
